General Terms and Conditions Mountain Hotels
We are pleased that you are interested in staying at MOUNTAIN HOTELS – thank you for placing your trust in us. These General Terms and Conditions are valid only for accommodation services. Tickets and other services are subject to the General Terms and Conditions of Davos Klosters Bergbahnen AG, which can be found here.
1. Conclusion of contract
On acceptance of a written, telephone, electronic or personal booking and the receipt of our confirmation, a contract is agreed between the guest and MOUNTAIN HOTELS, Davos Klosters Bergbahnen AG. These General Terms and Conditions are an integral component of the contract. Notifications by e-mail shall be deemed to have been made in writing.
2. Prices and payment terms
By making an electronic booking over the internet, guests declare their acceptance of our General Terms and Conditions. 50% of the total amount will be charged to the guest's credit card. For all other bookings, the confirmation form provided by us must be signed and a deposit of 25% of the total amount must be paid (by credit card or bank transfer). The balance is payable on arrival at the hotel. The contract will become legally valid on receipt of the deposit. If these conditions are not met, MOUNTAIN HOTELS may cancel the booking without notice. Item 4 below applies in relation to cancellation fees.
3. Price changes
MOUNTAIN HOTELS may change the published prices in the following cases:
- Newly introduced or increased statutory taxes/duties (e.g. VAT, visitors' tax)
- Exchange rate fluctuations (calculated on the basis of the daily rate of Davos Klosters Bergbahnen AG)
- Clearly explainable printing errors
4. Cancellations and booking changes
4.1 General conditions
Cancellations and booking changes are valid only if submitted in writing to MOUNTAIN HOTELS. They are subject to the following fees:
Package and hotel bookings – individuals (up to 3 double room/single room)
- Changes/cancellations up to 14 days before arrival: payments already made will be reimbursed in the form of a voucher
- Changes/cancellations 14 – 1 day before arrival: 50% of the reservation price
- Non-appearance or premature departure: 80% of the reservation price
Package and hotel bookings – groups (8 or more)
- Changes/cancellations up to 31 days before arrival: payments already made will be reimbursed in the form of a voucher
- Changes/cancellations 30 – 15 days before arrival: 50% of the reservation price
- Changes/cancellations 14 – 1 day before arrival: 80% of the reservation price
- Non-appearance or premature departure: 100% of the reservation price
These cancellation conditions apply only if and insofar as the cancelled room cannot be resold.
The date of cancellation is taken as the day on which the written notice is received by the booking office. On Saturdays, Sundays and public holidays, the next working day will prevail.
In cases of hardship, cancellation fees will be covered by travel/cancellation insurance, provided that the guest has taken out such a policy.
4.2 Provision of a replacement person
If the reservation cannot be honoured, MOUNTAIN HOTELS will accept a replacement person, who must take over the existing booking on the same terms. MOUNTAIN HOTELS must be notified as soon as possible of the replacement person (before arrival). The original guest will remain the contractual partner and will be liable towards MOUNTAIN HOTELS.
4.3 Cancellation in the event of force majeure
In the event of force majeure, such as political unrest, strikes, catastrophes, etc., MOUNTAIN HOTELS may cancel at short notice for safety reasons. In such case, payments already made will be reimbursed in the form of a voucher.
4.4 Disturbances and operational restrictions
Disturbances such as noise and/or operational restrictions shall not represent grounds for compensation or reimbursement.
5. Damages and liability
Claims must be asserted to MOUNTAIN HOTELS in writing as soon as possible, but within two weeks of departure at the latest.
MOUNTAIN HOTELS assumes no liability towards the guest if the non-fulfilment or incomplete fulfilment of the contract is caused by negligence on the part of the guest, unforeseen and unavoidable failings on the part of third parties or force majeure.
6. Use of hotel rooms
The guest must treat the hotel room with the utmost care. It may be used and occupied only by the number of people (including children) specified in the contract. Guests may not allow third parties to use the hotel rooms at MOUNTAIN HOTELS.
Guests are liable for any damage or loss, unless they can prove that it occurred through no fault of their own or that of other authorised users. MOUNTAIN HOTELS must be notified immediately of any damage or loss.
7. Extract from Terms and Conditions of Davos Klosters Bergbahnen AG (concerning ski passes):
In the event of accident or illness, ski passes valid for three days or more will be reimbursed on proof of a medical certificate, provided the pass has not been used from the date of the illness/accident (Item 3.1). If a pass is misused, a surcharge of CHF 250 will be imposed in accordance with Art.16 of the Swiss Transport Act. Operational restrictions, such as wind and weather conditions, avalanche risk or service interruptions, shall not represent grounds for reimbursement or compensation (Item 4.1). 8. Data protection
MOUNTAIN HOTELS is obliged to observe the applicable data protection legislation when handling and processing all customer data and customer usage data. Customer data will be used only to maximise operational reliability or in the interests of sales promotion, product design, crime prevention, the collection of key economic data and statistics, or for billing purposes.
The guest hereby acknowledges and agrees that in cases where services are provided in collaboration with third parties, MOUNTAIN HOTELS is entitled to share customer data with these third parties to the extent required to perform the services. In all other cases, customer data may be only shared with third parties with the explicit consent of the customer. The sole exception to this is if MOUNTAIN HOTELS has a legal obligation to share personal data with third parties.
9. Applicable law and place of jurisdiction
All contracts with MOUNTAIN HOTELS, Davos Klosters Bergbahnen AG, within the context of these General Terms and Conditions are subject to Swiss law exclusively. The place of jurisdiction for all disputes arising from such contracts is Davos.
