MOUNTAIN HOTELS General Terms of Business

We are delighted that you are interested in staying with us and thank you for the trust shown in MOUNTAIN HOTELS. These GTBs apply explicitly to accommodation services. Travel tickets and other services are subject to the GTBs of Davos Klosters Bergbahnen AG. These may be viewed on our homepage www.mountainhotels.ch (enter SUCHEN/WEBCODE w05

1. Conclusion of contract

Upon the acceptance of a written, telephone or personal booking and the provision of our confirmation, a contract is concluded between the guest and MOUNTAIN HOTELS, Davos Klosters Bergbahnen AG. These General Terms of Business are an integral part of the contract.
Notification by e-mail is considered as written notification.

2. Prices and conditions of payment

By making an electronic booking via Internet, the guest declares his agreement to our GTBs.
50% of the total amount will be charged to the guest’s credit card.
For all other bookings, the confirmation form provided by us must be signed and a deposit of 25% of the total amount paid (by credit card or bank transfer). The balance is to be paid on arrival at the hotel. The contract comes into effect upon receipt of the deposit.  In the event of non-compliance with these conditions, MOUNTAIN HOTELS have the right to cancel the booking without notification. Clause 4 below applies with regard to cancellation costs.

3. Price amendments

MOUNTAIN HOTELS may amend published prices in the following cases:

  • Newly introduced or increased statutory charges (e.g. VAT, guest taxes etc.).
  • Changes in exchange rates (will be charged at the daily exchange rate of Davos Klosters Bergbahnen AG).
  • Clearly explicable printing errors

4. Cancellations and booking changes

4.1 General conditions

Cancellations or booking changes are only valid if notified in writing to MOUNTAIN HOTELS. The following costs accrue: 

All-inclusive and hotel bookings for individuals (up to 3 double/single rooms)

  • Changes / cancellations up to 14 days before arrival date: deposits already paid will be reimbursed in the form of a voucher
  • Changes / cancellations 14 – 1 day before arrival date: 50% of the arrangement price
  • No-show or termination of arrangement: 80% of arrangement price

All-inclusive and hotel bookings for groups (from 8 persons) 

  • Changes / cancellations up to 31 days before arrival date: deposits already paid will be reimbursed in the form of a voucher
  • Changes / cancellations 30 – 15 days before arrival date: 50% of the arrangement price.
  • Changes / cancellations 14 – 1 day before arrival date: 80% of the arrangement price.
  • No-show or termination of arrangement: 100% of arrangement price.

These cancellation conditions are valid only if, and in so far as, the cancelled rooms can not be re-let.

The date of cancellation is determined as the date of receipt by the booking office of the written notification. On Saturdays, Sundays and public holidays, the definitive date is the next working day.

In cases of hardship, cancellation costs will be covered by cancellation insurance provided that such insurance has been taken out by the guest.

4.2 Provision of a replacement 

If the booked arrangement cannot be taken up, MOUNTAIN HOTELS will agree to a replacement person, who must accept the existing booking under the same conditions. MOUNTAIN HOTELS must receive early notification of the replacement person (before arrival). The guest who made the initial booking remains the contract partner and is liable to MOUNTAIN HOTELS.

4.3 Cancellation in the event of force majeure

In the event of force majeure, such as political unrest, disasters etc., MOUNTAIN HOTELS may also make a cancellation at short notice for safety reasons. In such cases, payment already made by the guest will be reimbursed in the form of a voucher.

4.4 Disturbances and limited operation

Disturbances such as noise and/or limited operations do not give any entitlement to compensation or reimbursement.

5. Liability for damages

Claims must be lodged in writing to MOUNTAIN HOTELS immediately or by the latest within two weeks of departure.

MOUNTAIN HOTELS bears no liability towards the guest if non-fulfilment or incomplete fulfilment of the contract is caused by default on the part of the guest, by unforeseen and unavoidable default by a third party or by force majeure.

6. Use of hotel room

The guest is to use and treat the hotel room with the greatest of care. It may only be used by the number of persons (including children) stated in the contract. It is prohibited for a guest to allow third parties to use a hotel room rented from MOUNTAIN HOTELS.
The guest is liable for any damages, unless it can be established that these have been caused through no fault of his or any other of his authorized users. MOUNTAIN HOTELS must be notified immediately of any damages.

7. Extract from the Davos Kosters Bergbahnen AG GTB (regarding ski pass terms of business)

Reimbursement for ski passes valid from three days will be made in case of illness or accident with a doctor’s confirmation, providing that the pass has not been used from the date of the illness/accident (Clause 3.1). In the case of misuse of a pass, a surcharge of CHF 250 will be levied in accordance with Art 16 of the Federal Transport Law (Clause 3.3).
Limited operation owing to the effects of wind and weather, avalanche danger or operational malfunction does not give entitlement to reimbursement or compensation (Clause 4.1).

8. Data protection

MOUNTAIN HOTELS pledge to observe the respective data protection laws during the use and processing of all customer data and customer usage data. Customer data will be used only to maximize operational security, or in the interest of sales promotion, product design, crime prevention, collection of economic key data and statistics as well as for invoicing purposes.

The guest accepts and agrees that in the case of joint preparation of services together with third parties, MOUNTAIN HOTELS is authorized to make available to the respective third party the extent of customer data as required in the interest of providing services. For the rest, transfer of customer data to a third party is permitted only with the explicit consent of the customer. The sole exception is if MOUNTAIN HOTELS are required by law to transfer customer data to a third party.

9. Applicable law and place of jurisdiction

All contracts concluded with MOUNTAIN HOTELS, Davos Klosters Bergbahnen AG within the framework of these GTBs are governed exclusively by Swiss Law. Davos is the sole place of jurisdiction in the case of any dispute arising from such contracts.
